La modificación del artículo 474° del código civil referente a la obligación reciproca de alimentos

Abstract

La presente investigación partió del problema ¿El artículo 474 del Código Civil referente a la obligación reciproca de alimentos en cuanto al inciso 2? “los descendientes y ascendientes” satisface la finalidad de la reciprocidad? Y el objetivo fue: Determinar si el artículo 474 del Código Civil referente a la obligación reciproca de alimentos en cuanto al inciso 2. “los descendientes y ascendientes” satisface la finalidad de la reciprocidad. La técnica que se empleó fue la encuesta y el instrumento fue el cuestionario. La población estuvo conformada por 100 abogados litigantes de la Provincia de Maynas, la muestra estuvo conformada por 80 abogados litigantes. El diseño que se empleó en la presente investigación es la “No experimental de tipo transaccional correlacional”. Para el análisis estadístico se usó la estadística descriptiva, para el estudio de las variables de manera independiente y para demostración de las hipótesis se usó la prueba paramétrica chi cuadrado (x2). Los resultados indicaron que: El artículo 474 del Código Civil referente a la obligación reciproca de alimentos en cuanto al inciso 2. “los descendientes y ascendientes” no satisface la finalidad de la reciprocidad, toda vez que el articulo resulta de contenido amplio y se debe delimitar en este inciso que los padres hayan cumplido con prestar alimentos a sus hijos, para que posteriormente este pueda solicitar alimentos a sus hijos ya mayores, cumpliéndose así la finalidad de la reciprocidad. Habiendo determinado lo anterior, podemos indicar entonces que resultaría factible modificar e incorporar un párrafo al artículo 474 del Código Civil en el extremo de precisar y especificar la obligación reciproca de alimentos.

For the statistical analysis, the descriptive statistics was used, for the study of the variables independently and for the hypothesis demonstration, the Chile square Parametric (X2) was used. The results indicated that: Article 474 of the Civil Code regarding the recipient obligation of food in terms of paragraph "2. The descendants and ascendants" does not meet the purpose of reciprocity, since the article results from broad content and must be delimited in this subsection that parents have fulfilled to provide food to their children, so that it is later possible to request food to their children and, greater, the thinner of reciprocity. Having determined the above, we can then indicate that it would be feasible to modify and incorporate a paragraph to Article 474 of the Civil Code at the end of specifying and specifying the reciprocal obligation of food.
