Abstract
Con el tiempo, los contratos se han convertido en un componente fundamental para que las personas realicen diversas adquisiciones, según Rodríguez (1998), considerando las opiniones de varios tratadistas, quienes sostienen que el desarrollo de una sociedad se mide por el aumento y evolución de los contratos, Por lo tanto, se puede afirmar que el contrato es utilizado como un medio para el tráfico legal de activos.
La promesa de contratar y el contrato de opción son dos contratos preparatorios regulados por nuestro Código Civil, de acuerdo con el artículo 2019 del Código Civil, solo el contrato de opción es considerado como un acto inscribible en el Registro Público, lo que excluye al otro contrato preparatorio con similitudes.
La presente investigación examinará las diferencias y similitudes de los contratos preparatorios, su relación con el registro público, las normas que los rigen, el estudio del derecho comparado, los efectos negativos de no registrar la promesa de contratar y los beneficios de ser considerado un acto inscribible.
