Abstract
Este análisis ha tenido como meta principal: Definir el grado de relación que existe entre el Debido Proceso y las acciones administrativas preparatorias en relación con el Debido Proceso al Procedimiento Administrativo Sancionador en la Municipalidad Provincial de Maynas en el 2023. En ese contexto, la investigación ha determinado la información desde el punto de vista del derecho administrativo a nivel estatal, identificando la forma en que se realizan los procedimientos administrativos de las infracciones cometidas por los empleados municipales. Se reconoce que en el procedimiento administrativo se respeta el debido proceso, el derecho a la defensa, la utilización de técnicas de prueba, como la imposición de sanciones administrativas como acciones correctivas frente a las conductas inadecuadas de los empleados municipales. Adicionalmente, se empleó un enfoque de estudio puro, de nivel correlacional, de diseño no experimental y de orientación cuantitativa. La investigación ha determinado que, en el procedimiento administrativo sancionador se lleva a cabo conforme al debido proceso, admitiendo diferentes evidencias como parte del procedimiento. En situaciones de responsabilidad, se imponen las sanciones de amonestación y suspensión como las más comunes, siendo la destitución del lugar de trabajo la más severa
The main objective of this analysis was to define the degree of relationship between Due Process and preparatory administrative actions in relation to Due Process for the Sanctioning Administrative Procedure in the Provincial Municipality of Maynas in 2023. In this context, the research has determined the information from the perspective of administrative law at the state level, identifying the way in which administrative procedures for infractions committed by municipal employees are carried out. It is recognized that the administrative procedure respects due process, the right to defense, and the use of evidentiary techniques, such as the imposition of administrative sanctions as corrective actions against inappropriate conduct by municipal employees. Furthermore, a pure study approach was used, at the correlational level, with a non-experimental design and a quantitative orientation. The research has determined that the administrative sanctioning procedure is carried out in accordance with due process, admitting different evidence as part of the procedure. In situations of responsibility, the most common sanctions are reprimands and suspensions, with dismissal from the workplace being the most severe.
