Modificación del artículo 316, numeral 2 del código civil para la exclusión de la obligación alimentaria de uno de los cónyuges por hijos extramatrimoniales, Iquitos, 2023

Abstract

La presente investigación analiza el numeral 2 del Artículo 316° del Código Civil, que establece la obligación alimentaria de ambos cónyuges a los hijos extramatrimoniales de uno de ellos. Sin embargo, se considera que esta responsabilidad debería ser solo del progenitor biológico. El problema general es: ¿La falta de claridad en el numeral 2 del artículo 316 del Código Civil, afecta la determinación de responsabilidades específicas dentro de la sociedad conyugal en casos de obligaciones alimenticias en hijos extramatrimoniales? estableciéndose el objetivo general: Analizar si la falta de claridad en el numeral 2 del artículo 316 del Código Civil, afecta la determinación de responsabilidades específicas dentro de la sociedad conyugal en casos de obligaciones alimenticias en hijos extramatrimoniales. La investigación utilizó un estudio cuantitativo, descriptivo y no experimental, con una muestra de 68 abogados litigantes del Colegio de Abogados de Loreto. Los resultados mostraron que la ausencia de claridad en la redacción del numeral 2 del artículo 316 del Código Civil perjudica la determinación de responsabilidades específicas dentro de la sociedad conyugal. Se plantea modificar el numeral 2 del artículo 316 del Código Civil para brindar una solución.

This research analyzes section 2 of Article 316 of the Civil Code, which establishes the alimentary obligation of both spouses to the extramarital children of one of them. However, it is considered that this responsibility should be solely that of the biological parent. The general problem is: Does the lack of clarity in section 2 of Article 316 of the Civil Code affect the determination of specific responsibilities within the marital society in cases of alimentary obligations to extramarital children? The general objective is: To analyze whether the lack of clarity in section 2 of Article 316 of the Civil Code affects the determination of specific responsibilities within the marital society in cases of alimentary obligations to extramarital children. This research used a quantitative, descriptive, and non-experimental study, with a sample of 68 litigating lawyers from the Loreto Bar Association. The results showed that the lack of clarity in the wording of section 2 of Article 316 of the Civil Code hinders the determination of specific responsibilities within the marital society. It is proposed to modify section 2 of Article 316 of the Civil Code to provide a solution.
