Incidencia de la violencia familiar en las demandas de divorcio por causal subjetiva: Análisis desde la perspectiva de los operadores de justicia (Iquitos, 2021-2024)

Abstract
El estudio de investigación actual evidencia que la violencia familiar forma parte de un sustrato que se encuentra presente en el 71% de las demandas de divorcio por causa subjetiva en la ciudad de Iquitos entre los años 2021 y 2024, siendo éste el detonante principal de la ruptura matrimonial. Sin embargo, muy aparte de sólo ser un dato estadístico, el estudio reveló una contradicción sobre los sesgos estructurales que median su judicialización. Los resultados son significativos, ya que mientras que el 93,3% de los encargados de la justicia consideran crucial la prueba de violencia física, únicamente solo el 50% le brinda igual importancia a la violencia psicológica y tan sólo un 26,7% a la violencia económica. Esta diferencia probatoria funciona como un filtro que no visibiliza las experiencias de maltrato, principalmente en aquellas que afectan significativamente a las mujeres, quienes son la persona demandante en un 82%. Se concluye que el sistema de justicia de familia en la ciudad de Iquitos genera una contradicción, ya que, a pesar de reconocerse la alta incidencia de la violencia, todavía se mantiene una cultura probatoria anacrónica que minimiza las pruebas no físicas, violando el derecho a una tutela judicial efectiva y exigiendo un cambio urgente de los protocolos de actuación con enfoque de género.
The current research study shows that domestic violence is a contributing factor in 71% of divorce petitions based on subjective grounds in the city of Iquitos between 2021 and 2024, making it the primary trigger for marital breakdown. However, beyond being merely a statistical data point, the study revealed a contradiction regarding the structural biases that influence its judicialization. The results are significant, as while 93.3% of those responsible for the justice system consider proof of physical violence crucial, only 50% give equal importance to psychological violence, and a mere 26.7% to economic violence. This evidentiary disparity acts as a filter that obscures experiences of abuse, particularly those that significantly affect women, who are the plaintiffs in 82% of cases. It is concluded that the family justice system in the city of Iquitos is contradictory, since, despite acknowledging the high incidence of violence, it still maintains an outdated evidentiary culture that minimizes non-physical evidence, violating the right to effective judicial protection and demanding an urgent change in the protocols for action with a gender perspective.
