Efectos de la extinción de dominio en la buena fe registral y seguridad jurídica, Maynas, 2023-2024

Abstract

La investigación partió del problema ¿Cómo impacta el artículo 31?2 del Decreto Legislativo 1373 en el principio de buena fe registral y la seguridad jurídica en la Provincia de Maynas, Departamento de Loreto? Y el objetivo fue: Analizar el impacto del artículo 31.2 del Decreto Legislativo 1373 en el principio de buena fe registral y la seguridad jurídica en la Provincia de Maynas, la metodología de la investigación fue de tipo cuantitativa, se aplicó la encuesta con un diseño correlacional no experimental, siendo eminentemente científica – Descriptivo – Explicativo, teniendo como principal resultado que el artículo 31.2 del Decreto Legislativo 1373 afecta negativamente el principio de buena fe registral y la seguridad jurídica en la Provincia de Maynas, Departamento de Loreto, al eliminar la presunción de buena fe, otorgar amplia discrecionalidad judicial sin criterios claros, y permitir el cuestionamiento de transacciones pasadas sin límite temporal definido.

The investigation started from the problem: How does article 31.2 of Legislative Decree 1373 impact the principle of good faith registration and legal security in the Province of Maynas, Department of Loreto? And the objective was: Analyze the impact of article 31.2 of Legislative Decree 1373 on the principle of good faith registration and legal certainty in the Province of Maynas, the research methodology was quantitative, the survey was applied with a correlational design non-experimental, being eminently scientific – Descriptive – Explanatory, with the main result that article 31.2 of Legislative Decree 1373 negatively affects the principle of good faith registration and legal certainty in the Province of Maynas, Department of Loreto, by eliminating the presumption of good faith, granting broad judicial discretion without clear criteria, and allowing the questioning of past transactions without a defined time limit
