Derecho al libre desarrollo de la personalidad en las fuerzas armadas sentencia 277/2023 (EXP. N 01844-2021-PA/TC)

Abstract

El presente trabajo en la sentencia 277/2023 EXP. N°. 01844-2021-PA/TC LIMA, Norka Valery Almonte Torres, la accionante interpone demanda de amparo, por vulneración de los derechos al libre desarrollo de la personalidad, a la debida motivación de las resoluciones administrativas y a la intimidad, en contra la Comandancia General del Ejército. En la estructura del trabajo, el Noveno Juzgado Constitucional de Lima, mediante Resolución N° 5, de fecha 04 de noviembre de 2019, declara en parte la demanda, ordenando la reincorporación de la accionante al servicio activo en el Ejercito del Perú en el grado de capitán. La Segunda Sala Constitucional de la Corte Superior de Justicia de Lima, mediante Resolución 9, de fecha 18 de febrero de 2021, revoca la apelada y declara improcedente la demanda por estimar que la sanción disciplinaria militar debe cuestionarse a través del proceso contencioso-administrativo. El Tribunal Constitucional mediante sentencia de fecha 27 de abril de 2023, declara fundada en parte la demanda de amparo, por haberse acreditado la vulneración de los derechos al libre desarrollo de la personalidad, a la debida motivación de las resoluciones administrativas y a la intimidad, y nula la Resolución de la Comandancia General del Ejército 0521 CGE/DACOCOM, de fecha 31 de mayo de 2018.

The present work in sentence 277/2023 EXP. No. 01844-2021-PA/TC LIMA. Norka Valery Almonte Torres, the plaintiff, files a claim for protection, for violation of the rights to free development of personality, to due motivation of administrative resolutions and to privacy, against the General Command of the Army. In the structure of the work, the Ninth Constitutional Court of Lima, through Resolution No. 5, dated November 4, 2019, partially declares the claim, ordering the reinstatement of the plaintiff to active service in the Peruvian Army in the rank of captain. The Second Constitutional Chamber of the Superior Court of Justice of Lima, through Resolution 9, dated February 18, 2021, revokes the appeal and declares the lawsuit inadmissible because it considers that the military disciplinary sanction must be questioned through the contentious-administrative process. The Constitutional Court, through a ruling dated April 27, 2023, declares the claim for protection partially founded, as the violation of the rights to free development of personality, to due motivation of administrative resolutions and to privacy has been proven, and null and void the Resolution of the General Command of the Army 0521 CGE/DACOCOM, dated May 31, 2018.
